RE: AWARD OF CONTRACT FOR THE CONSTRUCTION OF ZING-YAKOKO-MONKIN ROAD IN TARABA STATE CONTRACT NO. 6151
TERMINATION OF CONTRACT
(1) Please recall that the above Contract was awarded to your Company by the Ministry on the 14th of December, 2012 for the Construction of Zing-Yakoko-Monkin Road in Taraba State Contract No.6151 in the sum of N 1,043,029,772.40. You were issued the Engineer’s Order to commence work on 9th March, 2013 and to complete same on or before 8th March, 2014, with a completion period of twelve (12) months.
(2) In fulfillment of the Federal Government’s obligation under the Contract Agreement and to facilitate the speedy and smooth take off of the project, a Total sum of N156,454,565.00 was paid to your Company to enable you mobilize to site.
(3) However, it is pertinent to note that your percentage of work completion remains at 7.94% with a time lapse of 873.00% after the expected completion period. Your continued absence from the site and abysmal performance has negatively affected the expected socio-economic gains of the project, despite the series of warning letters served on you.
(4) Consequently, the Ministry issued you with 14 days’ Notice of Intention to terminate the Contract dated 6th August, 2018 through a publication on the Daily Trust edition of November, 2019 because all effort to trace you in your business address proved abortive. The Ministry was thereafter informed through the FCW/ER, Taraba State that you have resumed work at Site within the period of the Notice and pleaded for the retraction of the termination. Also, you have submitted a programme of work with specific milestone to be achieved within three (3) months on conditions that there will be no farther augmentation of the original Contract sum, or else the contract will be terminated.
(5) It should be noted, however, that despite the Ministry’s gracious consideration by allowing you to resume and continue work at Site on the above arrangement, you again abandoned the Site since May, 2021 after failure to achieve the specific milestones within the 3 months grace. Your continued abandonment of site and poor performance clearly shows your lack of capacity and commitment to execute the project successfully. This has left the Ministry with no option than to have the Contract terminated.
(6) In view of the above, and in accordance with the terms of the Contract Agreement executed between the Ministry and your Company and the provisions of Clause 63 of the Standard Conditions of Contract, (Road Works) Volume I, 2016 Edition, the above Contract is hereby terminated forthwith effective from the date of service of this letter on you.
(7) The Engineers Representative shall, upon service of this letter on you, arrange with you for a joint measurement of work for final account preparatory to taking over the site and work from your Company. This is without prejudice to the exercise of other rights of the Federal Government under the Contract please.
